The "No-Fault" Eviction Ban: What You Need to Know

The Renters' Rights Act 2025 has passed, banning Section 21 "no-fault" evictions. However, the ban does not start until May 1, 2026.

Until May 1, 2026: Landlords can still serve Section 21 notices, but they must give you 2 months' notice. From May 1, 2026: Section 21 is banned completely. All tenancies become "periodic" (rolling), and fixed-term tenancies are illegal.

[!WARNING] Transitional Rule: If you receive a Section 21 notice before May 1, 2026, your landlord has a limited time (approx. 3 months) to take it to court. If they miss this deadline, the notice expires forever.

Is Your Eviction Notice Legal? (The Checklist)

Even if your landlord serves a Section 21 notice before the ban, it might be invalid. Use this checklist to see if you can challenge it.

  • Did you get the "How to Rent" guide? Your landlord must have given you the government's "How to Rent" booklet at the start of your tenancy. No booklet = invalid notice.
  • Is your deposit protected? Your deposit must be in a protection scheme (TDS, DPS, MyDeposits) within 30 days of paying it. If not, the notice is invalid (and you might be owed compensation).
  • Is the Gas Safety Certificate valid? You must have a valid Gas Safety Certificate. If they didn't give you one before you moved in (or before the notice), the eviction is invalid.

The "Retaliatory Eviction" Check

Landlords cannot evict you just because you asked for repairs. This is called "Retaliatory Eviction" and it is illegal.

If you complained about a problem (like damp or a broken boiler) to your local council and they served an "Improvement Notice" on the landlord, your landlord cannot use Section 21 for 6 months.
